Judges and Facebook?

December 20, 2009

New York Times newspaper published an interesting article about judges, lawyers and Facebook. The Florida’s Judicial Ethics Advisory Committee made an opinion that judges are not allowed to have lawyers on their Facebook page as friends. Because of their Facebook friendship, any legal procedure by the judge might convey to others that these lawyers are in a special position to influence the judge.

I really liked their opinion especially when they combine one of our daily usage tools with a judge decision in a case. On the other hand, I think they went so far with this decision. It is true that judges should be neutral; but at the same time we can’t keep them away from reality. Luckily, the civil procedure law in Kuwait does not have such condition. The relationship between judges and lawyers was mentioned in title 102 that the judge shall disqualify himself if he is related to an attorney of either party within two degrees of kinship.

Kuwaiti judges, you are safe from using Facebook!
